Victimización Secundaria, Percepción De Una Usuaria Frente A Los Procesos En El Ámbito Familiar

Abstract

En este trabajo se propone conocer la perspectiva de la participante ante procesos del ámbito familiar, esto debido a que interpuso la denuncia por violencia intrafamiliar. Se aborda el fenómeno de la victimización secundaria el cual implica factores negativos entre la atención producida por los funcionarios ante las víctimas (Pabón et al, 2018), lo que influye en como la participante construye su realidad y decide por continuar los trámites tiempo después. Por lo tanto, se aborda la victimización secundaria, el derecho al debido proceso, los trámites extraprocesales como las conciliaciones de cuota alimentaria, custodia y régimen de visitas. La investigación parte desde los paradigmas histórico-hermenéutico y la fenomenología considerando que se comprende las vivencias de la participante que permiten la construcción de su realidad analizada desde el construccionismo. Como resultados se conoce la percepción de la participante y se identifica el fenómeno de la victimización secundaria resaltando elementos como la dilatación del proceso, falta de empatía de los funcionarios, ineficacia de los procesos, entre otros aspectos característicos de este tipo de victimización. ABSTRACT In this study we propose to know the perspective of the participant before processes in the family environment, because she filed a complaint for domestic violence. It addresses the phenomenon of secondary victimization which involves negative factors among the attention produced by officials to the victims (Pabón et al, 2018), which influences how the participant constructs her reality and decides to continue the proceedings sometime later. Therefore, secondary victimization, the right to due process, extraprocedural procedures such as child support, custody and visitation regime conciliations are addressed. The research starts from the historical-hermeneutic paradigms and phenomenology considering that the experiences of the participant are understood, which allow the construction of her reality analyzed from constructionism. As results, the perception of the participant is known and the phenomenon of secondary victimization is identified, highlighting elements such as the delay of the process, lack of empathy of the officials, ineffectiveness of the processes, among other characteristic aspects of this type of victimization.
