Obligaciones legales de las organizaciones objeto de vigilancia y fiscalización según la normatividad colombiana: Estudio de caso en Industrializados OMP S.A.S, Bogotá D.C.

Resumen Las empresas del sector de la construcción adquieren responsabilidades legales las cuales se deben identificar y cumplir, el objetivo principal de esta investigación es establecer como OMP S.A.S cumple con las obligaciones legales objeto de vigilancia y fiscalización según la normatividad colombiana por parte de la Revisoría Fiscal. Para la metodología de esta investigación se realizó una revisión de fuentes legales investigando la legislación colombiana, luego se realizaron dos entrevistas a personal clave de la empresa para identificar si OMP S.A.S, aplica y cumple con las obligaciones legales que establece la legislación colombiana. Los hallazgos de esta investigación se presentan en tres capítulos los cuales describen las obligaciones que tiene industrializados OMP SAS. de acuerdo con la Ley colombiana, examina el sistema de aseguramiento que permite a la empresa OMP S.A.S. cumplir con todas las obligaciones requeridas por la ley y asocia el cumplimiento de las obligaciones legales de OMP S.A.S. con la labor de la Revisoría Fiscal. Se concluye de manera general la necesidad de que empresas como OMP S.A.S se mantengan informadas y cumplan con las obligaciones legales del sector de la construcción, enfatizando que el cumplimiento riguroso no solo garantiza la legalidad de las operaciones, sino que también promueve la transparencia, confianza pública y sostenibilidad a largo plazo en el mercado colombiano, finalmente la labor de la Revisoría Fiscal en OMP S.A.S emerge como un respaldo esencial para el cumplimiento normativo de la empresa. Su enfoque proactivo aborda áreas cruciales, contribuyendo de manera significativa a la sostenibilidad, confianza pública y legalidad en todas las facetas de la actividad empresarial de OMP S.A.S. Abstract The construction sector companies acquire legal responsibilities that must be identified and fulfilled. The main objective of this investigation is to establish how OMP S.A.S complies with the legal obligations subject to monitoring and oversight according to Colombian regulations by the Fiscal Auditing. For the methodology of this investigation, a review of legal sources was carried out by examining Colombian legislation. Subsequently, two interviews were conducted with key personnel of the company to identify whether OMP S.A.S applies and complies with the legal obligations established by Colombian legislation. The findings of this investigation are presented in three chapters describing the obligations that OMP SAS has as an industrialized entity according to Colombian law. It examines the assurance system that allows OMP S.A.S to fulfill all obligations required by law and associates the compliance of OMP S.A.S with legal obligations with the work of the Fiscal Auditing. In general, the need for companies like OMP S.A.S to stay informed and comply with legal obligations in the construction sector is emphasized. It highlights that rigorous compliance not only ensures the legality of operations but also promotes transparency, public trust, and long-term sustainability in the Colombian market. Finally, the role of the Fiscal Auditing in OMP S.A.S emerges as an essential support for the company's regulatory compliance. Its proactive approach addresses crucial areas, contributing significantly to sustainability, public trust, and legality in all facets of OMP S.A.S's business activities.
